LAS VEGAS (AP) — A Nevada judge says she's leaning toward cutting a paralytic from the three-drug combination the state plans to use for the execution of a death-row inmate who said again he wants his sentence carried out next week.
Clark County District Court Judge Jennifer Togliatti told federal public defenders and state attorney general lawyers on Wednesday that she expects to make a decision Thursday.
She says she first wants state prison officials to finalize, sign and submit their protocol for the execution next Tuesday of Scott Dozier.
The 46-year-old Dozier told the judge by video from prison that he's "resolute and steadfast" about not changing his mind about becoming the first person in Nevada to be killed by lethal injection in 11 years.
Dozier is a twice-convicted murderer who voluntarily gave up appeals of his conviction and sentence.
