Prosecutors say a former top deputy Utah attorney general has been arrested to make sure he'll testify against his ex-boss next month.
Jail records show Kirk Torgensen was being held on $100,000 bail on a material witness warrant at Salt Lake County jail Tuesday.
Salt Lake County District Attorney Sim Gill says the arrest shows there are consequences for those who don't follow court orders. He declined to say exactly what led to the arrest but said Torgensen is not facing charges.
Torgensen's lawyer Brett Tolman calls the arrest absurd. He says his client wants to testify, but he has a nonrefundable family trip that conflicts with the February trial date for former Utah Attorney General John Swallow.
Swallow has pleaded not guilty to bribery and other charges.
