LAS VEGAS (AP) — Attorneys for a California tech billionaire are telling a Las Vegas judge that prosecutors can't prove ownership of the hard-sided luggage in which police reported finding numerous drugs in his hotel room almost a year ago.
In a court filing Wednesday, lawyers for Broadcom co-founder Henry Nicholas III and co-defendant Ashley Fargo seek dismissal of all five drug trafficking and two possession charges against them.
Nicholas also is primary backer of the "Marsy's Law" crime victim rights measure.
The document argues ahead of a July 31 preliminary hearing that people came and went for several days from an Encore resort room where Fargo was found unconscious last August.
Prosecutors say heroin, methamphetamine, cocaine and several synthetic and natural psychedelic substances were in two closed hard-sided cases found in the room.
