Nye County DA Says Question 1 Background Checks Aren't Enforceable

The district attorney in Nye County has said Nevada's new law requiring background checks on all firearms transfers is "unenforceable."

The Pahrump Valley Times reports Angela Bello made the remarks after the state's attorney general, Adam Laxalt, said his office could not enforce the measure as passed by voters as Question 1 in November.

The measure calls for FBI background checks to take place for all private gun sales, but the FBI has said it cannot conduct them because the ballot question passed cannot tell the federal government what to do.

The FBI would need additional resources in order to carry out the new background checks from Nevada as well.

As a result, the law remains in limbo while Nevada finds an administrative workaround.
