Nevada AG: State Court Has To Review Search-Seizure Rules

ELKO, Nev. (AP) — Nevada state Attorney General Adam Laxalt says the state Supreme Court will have to revisit a decision about search-and-seizure rules last year in a case about the arrest of a California man in Elko.

Laxalt pointed Monday to a recent ruling by the U.S. Supreme Court in a similar case from Utah focusing on the key question of how long police can detain someone without probable cause.

In Nevada, the state high court decided an Elko police officer didn't improperly detain Ralph Torres after Torres produced identification showing he was old enough to be out past curfew.

The officer arrested Torres on a felony warrant from California and found that Torres had a gun in his pocket.

Torres later pleaded guilty to being an ex-felon firearm possession charge.
