Death Row Inmate Has 28th Appeal Denied

An appeals court has denied a Nevada death row inmate's 28th attempt to overturn his conviction.

The Las Vegas Sun reports that Rodney Emil has been on death row since 1988 for a Las Vegas killing.

The 9th U.S. Circuit Court of Appeals turned down a petition for a writ of habeas corpus on Friday. Court documents say Emil argues that prosecutors failed to file the correct charges against him.

Documents say the now-55-year-old Emil was convicted in 1988 of killing his stepfather, Charles Howard, who was shot four times.

Court records also show that Emil is also serving two life sentences without the possibility of parole for the 1983 killing of Ross Tolley in Las Vegas.
