Convenience Store Employees Sue For Overtime Pay

Chuck Grahl is one of 59 former and current Circle K employees in Nevada and Arizona suing the convenience store chain for allegedly intentionally misclassifying them as store managers to keep them from getting overtime pay.

The class-action lawsuit argues the employees should not have been given management titles because their daily tasks included non-management duties, including unloading boxes and cleaning restrooms.

Las Vegas attorney Andy Rempfer represents the current and former Circle K workers. Rempfer said Circle K does not have discretion to independently categorize workers as managers, especially those employees who just work the cash registers.

A Circle K spokeswoman was unavailable for comment. Rempfer said mediation between the Circle K workers and the company is scheduled for September.
