School Choice Program Lawsuit Up For Las Vegas Court Hearing

LAS VEGAS (AP) — A lawsuit against the state's sweeping new school choice program is up for a hearing in a Las Vegas court.

Lawyers for the state are expected to defend the Education Savings Accounts program Wednesday afternoon against a legal challenge filed last summer by the American Civil Liberties Union.

The voucher-style program allows parents to claim the majority of their child's per-pupil education funds and use it toward private schooling.

ACLU officials say it violates a portion of the Nevada Constitution that bans using public funds for sectarian purposes.

A Carson City judge reviewing a separate lawsuit put the program on hold earlier this year, while there's been no ruling in the Las Vegas case. State lawyers hope the cases can be consolidated and resolved together at the Nevada Supreme Court.
