LVMPD Investigating Claims Lawyer Pulled Gun During Deposition

Police are investigating a report that a Las Vegas lawyer pulled a gun during a high-tension deposition in his office.

The Las Vegas Review-Journal reports the allegation is detailed in court papers filed against attorney James Pengilly. He denies drawing the weapon.

The plaintiff says Pengilly chased him into the parking lot with the gun because he was angry about a libel case filed against him. Plaintiff Mark Stuhmer claims the attorney seemed determined to shoot him and claim self-defense.

Pengilly tells the newspaper he always carries a gun for protection, but said he didn't pull the weapon during the Sept. 20 deposition. He calls the allegation a stall tactic in the libel case.

No arrests have been made and Pengilly remains in good standing with the State Bar of Nevada.
