The ACLU of Nevada is investigating the Elko County School District's decision to deny a transgender student from using the bathroom he wishes.
The Elko Daily Free Press reports the organization wrote the district, saying various court cases have upheld a student's right to use the facilities they prefer.
The ACLU also alleges the school district's decision violates Title IX legislation because schools are federally mandated to protect students from bullying based on gender identity or expression, and that the public hearing violated the student's right to privacy by essentially outing him.
