9th Circuit Court Won't Hear Appeal Against Gay Marriage

The 9th Circuit Court of Appeals has denied a request to rehear a ruling that overturned Nevada’s ban on same-sex marriage. 

An order dated Friday says the court was advised of a petition to rehear the case, filed by the Nevada Coalition for the Protection of Marriage in October and asking the court’s full panel of 29 active judges review the case.  Only three judges responded, so the request was denied. 

The ruling also applied to Idaho, whose ban also was overturned last year. The court is based in San Francisco.
