RENO, Nev. (AP) — A dispute over misconduct allegations by a Nevada school superintendent is likely to result in a court case, officials said.
The Washoe County School District board will decide Monday whether to fire Superintendent Traci Davis, The Reno Gazette-Journal reported Thursday.
Davis denied she is responsible for a leak of documents related to an investigation into special education department leaders.
Davis and officials from the district expect the case to move to a courtroom.
If Davis is fired for cause at Monday's special meeting in Reno, she is prepared to immediately file a lawsuit, according to her attorney, William Peterson.
"We will go Monday and make a statement, but I believe they will fire her," Peterson said.
"The bottom line is Traci didn't do this," Peterson said. "The district never did any kind of investigation."
The district has a "substantial case," said Board of Trustees President Katy Simon Holland.
"We are very confident that the evidence is substantial and that it is easy to come to a reasonable conclusion that egregious negligence in her duties as a CEO has occurred," Holland said.
The case would be heard and the outcome determined by a judge without a jury.
If Davis is cleared of wrongdoing in court, her contract stipulates she is entitled to pay she would have received if she had been fired without cause. That includes a year's salary, pay for notice of 90 days and any accrued sick leave and vacation time.
The contract does not entitle her to additional money for damages if she prevails in court.
The cost to the district to defend against the prospective lawsuit is unfortunate, Holland said.
"It's what we do, but people have a right to contest our decisions," she said. "We are confident we have a substantial case."
