State Lawmaker's DUI Conviction Overturned

A Carson City judge has overturned a Nevada assemblyman's driving under the influence conviction.

The Nevada Appeal reports Judge James Wilson found Tuesday that a blood test wasn't admissible evidence against Democratic lawmaker Richard Carrillo.

The decision was based on a crime lab technician's testimony that she didn't control all stages of the blood test that found Carrillo's blood alcohol content was above the legal limit.

Deputies say Carrillo was found asleep in the driver's seat of his car Feb. 27 after reportedly leaving a bar near the Capitol during the legislative session. Authorities say he had a loaded .22-caliber pistol in his pocket.

The ruling cancels out penalties including 42 hours of community service and $800 in fines. Carrillo said the decision lifts a huge weight off him.
