Utah Extends Appeal Deadline For Spousal Benefits

Utah has an extra month to file its appeal of a federal judge’s order that the state extend spousal benefits to same-sex couples who wed in Utah during during the short period such unions were legal. 

The 10th Circuit Court of Appeals on Tuesday granted the state’s request for more time, moving the date from September 22 to October 22.  The state asked for extra time, citing strained resources and the complexity of the lawsuit. Evans v. Utah challenges the state to recognize the marriages of more than 1,200 gay and lesbian Utahns who married. Plaintiff’s attorneys last week filed a brief with the court saying that the longer their clients are forced to wait for spousal benefits, the greater the chance harm may come to them.
