SALT LAKE CITY (AP) — A state regulatory appeals board says Utah may have erred in choosing only eight growers for a medical marijuana program set to launch next year.
A three-person panel consisting of two state employees and a private attorney made the comment in a written decision made public Thursday rejecting the latest appeal from one of the companies that wasn't chosen to grow medical marijuana.
The panel upheld an earlier denial of the appeal but agreed with the company's objection to the state not selecting 10 growers as allowed under the law. The panel asked the Utah Department of Agriculture to review that decision.
It was not immediately clear if the board's feedback would force the state to reassess its decision.
Agriculture officials didn't immediately have a comment.
They previously said they chose eight growers to avoid an oversupply of marijuana.
