CARSON CITY, Nev. (AP) — A UNLV student is suing a Nevada assemblyman who's expected to move to another district in coming weeks and run for a state Senate seat.
The lawsuit filed against Republican Assemblyman Erv Nelson on behalf of 21-year-old Ryan Fink asks the court whether someone can retain a seat if they've announced intentions to leave it.
Nelson still holds his seat in Las Vegas' Assembly District 5, but would have to move into a nearby district by mid-February to legally fulfill his stated plan of running for Senate District 6.
Senate Republican leaders endorse Nelson. His primary opponent is Assemblywoman Victoria Seaman, who seeks to paint Nelson as a carpetbagger.
Nelson called the lawsuit spurious. He added that he remains engaged with his constituents in District 5 and his Assembly duties.
