ACLU Fights Elko Transgender Student Decision

The American Civil Liberties Union of Nevada is fighting a decision by the Elko County School Board to deny a transgender student's request to use the facilities of his choice.

The Elko Daily Free Press reports the group wrote to the board on Tuesday, saying their decision "deliberately and continuously" violates the student's rights under federal Title IX legislation.

The group also says the decision violates Nevada state anti-discrimination law, which mandates facilities provide equal facilities and accommodations based on gender identity, and the state's anti-bullying law, which attempts to prevent a hostile educational environment for students.

The Elko Daily Free Press says the county's superintendent, Jeff Zander, anticipated some kind of legal action or response from the ACLU when the decision was made.
