Evidence Hearing Begins In FBI-Caesars Search Case

Lawyers for Malaysian man and his son are asking a federal judge in Las Vegas on Monday to throw out evidence in an international Internet gambling case because FBI agents posed as repair technicians to get into their clients' suites at Caesars Palace.

Defense attorney David Chesnoff says no American would be safe at home if searches can be based on deception like the FBI used to obtain search warrants in the case against Wei Seng Phua and Darren Wai Kit Phua.

Chesnoff and attorney Thomas Goldstein want U.S. Magistrate Judge Peggy Leen to throw out evidence that was collected as the tainted result of an unconstitutional ruse.

Prosecutors deny the government used improper tactics to get probable cause for a warrant to enter Phua's high-roller suites.
